These Terms of Service ("Terms") are a binding agreement between you and [LEGAL ENTITY NAME] ("CycleMate", "we", "us", or "our") and govern your use of the CycleMate mobile application, website, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. CycleMate is not medical advice
CycleMate is a peer-support community and personal tracking tool. It is not a medical device, not a healthcare provider, and does not provide medical advice, diagnosis, or treatment.
- Nothing in the Service — including daily tips, affirmations, articles, cycle timelines, phase descriptions, or messages from other members — is a substitute for professional medical advice from your fertility clinic, physician, or other qualified health professional.
- Other members are not medical professionals. Anything they share reflects their own personal experience only.
- Cycle days, "days past transfer" (for example 5dp5dt), phase labels, and estimated milestones are convenience calculations based on the dates you enter. They may be inaccurate and must never be used to make treatment decisions.
- Always consult your clinician before starting, stopping, or changing any treatment, medication, or protocol. Never disregard or delay seeking professional medical advice because of something you read in the Service.
- If you believe you are experiencing a medical emergency, contact your clinic or local emergency services immediately. The Service is not monitored for emergencies.
2. Eligibility
You must be at least 18 years old and able to form a binding contract in your country of residence to use the Service. By using the Service you represent that you meet these requirements. We may suspend or remove any account we reasonably believe belongs to a minor.
3. Your account
- You agree to provide accurate information when registering and to keep it current.
- You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
- You may use a nickname rather than your legal name. You must not impersonate any other person, clinic, or organisation.
- Accounts are personal to you. Do not share, sell, or transfer your account.
- Please notify us promptly at [SUPPORT EMAIL] if you suspect unauthorised use of your account.
4. Community rules
CycleMate exists so that nobody goes through IVF alone. To keep it a safe and supportive place, you agree that you will:
- Be kind. Treat every member with respect. No harassment, hate speech, personal attacks, shaming, or unsolicited criticism of another member's choices.
- Respect privacy. What is shared in the community stays in the community. Do not screenshot, republish, or share another member's content, images, or personal details outside the Service.
- Not give medical advice. Share your experience, not prescriptions, dosages, or protocols for others to follow.
- Not sell or recruit. No advertising, promotion of products or services, multi-level marketing, fundraising, or recruiting for external groups without our prior written permission.
- Not misuse the Service. No unlawful, fraudulent, obscene, or harmful content; no spam or automated scraping; no attempt to breach security, access another member's account, or interfere with the Service's operation.
You agree to comply with our Community Guidelines, which form part of these Terms.
5. Content you share
You retain ownership of the content you post, including messages, photos, symptom logs, and profile information ("Your Content"). By posting Your Content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display it solely for the purpose of operating, securing, and improving the Service.
You confirm that you have the right to share Your Content and that it does not infringe anyone else's rights. We do not routinely pre-screen content, but we may review, moderate, remove, or restrict any content at our discretion, including content reported by members.
6. Moderation, suspension, and removal
We may issue warnings, remove content, restrict features, suspend, or permanently terminate your account — with or without notice — if we reasonably believe you have breached these Terms or the Community Guidelines, or where necessary to protect members, the public, or the Service.
You may report a message or member from within the app. Reports are reviewed by our moderation team. You may also block another member at any time, which prevents further contact between you.
7. Matching and community features
The Service may match you with other members ("mates") based on information you provide, such as your cycle type and cycle day. Matching is automated and offered on a best-effort basis. We do not guarantee that you will be matched, that matches will be available in your stage, or that any match will be a good fit. Membership of community channels may require approval and may be revoked in line with Section 6.
We do not verify the identity, statements, qualifications, or intentions of any member. You interact with other members at your own risk and should use the same caution you would with any online community. Never share financial information or sensitive identifying details with another member.
8. Privacy and health information
The Service involves information about your fertility treatment, which is sensitive. Our Privacy Policy explains what we collect, how we use it, and the choices and rights available to you, and forms part of these Terms.
Please be aware that anything you choose to post in a community channel, group, or chat is visible to other members of that space. Consider carefully what you share.
9. Notifications
The Service may send push notifications and in-app messages, such as daily tips, match alerts, message notifications, and important service announcements. You can manage most notification preferences in the app or in your device settings. We may still send essential service or security messages.
10. Third-party content and partners
The Service may display articles, resources, partner listings, or links to third-party sites. These are provided for information only and do not constitute an endorsement or recommendation. We are not responsible for third-party content, products, services, or privacy practices. Any dealings you have with a third party are solely between you and them.
11. Our intellectual property
The Service, including its software, design, text, graphics, logos, and the CycleMate name and branding, is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use, subject to these Terms. You must not copy, modify, reverse engineer, resell, or create derivative works from the Service.
12. Availability and changes to the Service
We aim to keep the Service available, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms; where changes are material we will give reasonable notice through the app or by email before they take effect. Continuing to use the Service after the changes take effect means you accept the updated Terms.
13. Ending your use
You may stop using the Service at any time and may delete your account from within the app. Deletion is permanent and removes or anonymises your personal data as described in the Privacy Policy. Some content may remain where other members have interacted with it, and we may retain limited records where required by law. Sections that by their nature should survive termination — including Sections 5, 11, 14, 15, 16, and 17 — will continue to apply.
14. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the Service will meet your requirements, that information in the Service is accurate or complete, or that member-generated content is reliable. We are not responsible for the conduct of any member, online or offline.
15. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or emotional distress, arising out of or relating to your use of (or inability to use) the Service, any member's conduct or content, or any decision made in reliance on information in the Service.
Our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the total amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) [AMOUNT, e.g. USD 100].
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
16. Indemnity
You agree to indemnify and hold harmless CycleMate and its officers, employees, and agents from any claims, losses, liabilities, and reasonable legal costs arising from your breach of these Terms, your misuse of the Service, or content you post.
17. Governing law and disputes
These Terms are governed by the laws of [JURISDICTION], without regard to its conflict-of-law rules. The courts of [JURISDICTION] will have exclusive jurisdiction over any dispute, except that consumers may also have the right to bring proceedings in their country of residence where local law requires.
Before starting formal proceedings, we ask that you contact us so we can try to resolve the matter informally.
18. General
- These Terms, together with the Privacy Policy, Cookie Policy, and Community Guidelines, are the entire agreement between you and us regarding the Service.
- If any provision is found unenforceable, the remaining provisions stay in effect.
- Our failure to enforce a provision is not a waiver of it.
- You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
